This Privacy Policy explains how Open Real Estate, LLC ("Open Real Estate," "we," "us") collects, uses and shares personal information through openrealestate.com (the "Site").
1. Information we collect
You provide it through our forms:
- Brokerages and franchises: brokerage/franchise name, organization type, your name, title, work email, phone number (if provided), states or markets served, approximate agent count, your confirmation of authority, your organization’s logo (if you choose to upload one), and whether you consent to Open Real Estate publicly identifying your organization, including its name and logo, as a supporter.
- Agents: full name, email address, brokerage, and state.
- Consent records: the date and time of your submission, the consent language shown, and related technical details such as IP address, so we can document your consent.
Collected automatically: IP address, browser and device type, pages viewed and similar log data, and cookies or similar technologies used to operate and secure the Site and to measure how it is used (see Cookies and analytics below).
We do not knowingly collect sensitive personal information, and we ask that you do not submit any.
2. How we use information
We use your information to: respond to your submission and provide next steps; send updates, invitations to informational sessions and other communications about Open Real Estate by email and, where you have consented, phone and text; plan and develop the initiative, including understanding participation by market and size; operate, secure and improve the Site; keep records of consent and opt-outs; and comply with law.
3. Email, phone and text communications
We will contact you by email at the address you provide. If you provide a phone number and consent, we may call or text you about the initiative, including with automated technology. Consent is not a condition of joining or receiving updates by email. You can opt out any time: use the unsubscribe link in any email or reply STOP to any text. We will honor opt-outs promptly. Message frequency varies; message and data rates may apply.
We do not sell your phone number or text-message consent information, and we do not share them with third parties for their own marketing.
4. How we share information
We do not sell your personal information. We may share it with: service providers that help us run the Site and send communications (for example, hosting, analytics, email, text-messaging and form or database vendors), who may use it only to provide services to us; our founding members and participating organizations, solely for purposes of the initiative; professional advisers; authorities when required by law or to protect rights and safety; and a successor if we are involved in a merger, financing or sale of assets.
5. Cookies and analytics
We use cookies and similar tools necessary to operate the Site.
We also use Google Analytics, a web analytics service provided by Google LLC, to understand how visitors use the Site, such as pages viewed, time spent on the Site, the referring website, device and browser type, and approximate location derived from IP address. Google Analytics uses cookies and similar technologies to collect this information, and Google processes it on our behalf and as described in its own policies. We do not send your name, email address, phone number or other form entries to Google Analytics. 6. Retention
We keep personal information as long as needed for the purposes above, and to meet legal, accounting and record-keeping obligations (including consent records), then delete or de-identify it. If you opt out of communications, we keep your contact details on a suppression list so we do not contact you again.
7. Your choices and rights
You can unsubscribe from communications at any time. Please use the unsubscribe link in any email you receive from us or reply STOP to a text message to exercise such rights.
8. Security
We use reasonable administrative, technical and physical safeguards. No system is completely secure, so we cannot guarantee absolute security.
9. Children
The Site is for adult professionals and is not directed to children under 18. We do not knowingly collect information from children.
10. Data location
The Site is operated in the United States, and information may be processed and stored here.
11. Changes
We may update this Policy and will post the new effective date. Material changes affecting how we use your information will be communicated where required by law.
