Terms of Service
These Terms of Service ("Terms") govern your use of openrealestate.com (the "Site"), operated by Open Real Estate, LLC ("Open Real Estate," "we," "us"). By using the Site or submitting a form, you agree to these Terms. If you do not agree, do not use the Site.
1. About the Site
The Site provides information about Open Real Estate, a proposed national real estate data-distribution initiative, and lets brokerages and real estate agents express interest and request updates. The initiative is in development. Plans, features, timelines and participants may change.
2. Who may use the Site
The Site is intended for real estate professionals and organizations, and you must be at least 18 years old. If you submit on behalf of a company, you confirm that you are authorized to do so.
3. Submissions are not binding
A brokerage "letter of support" or an agent sign-up is only an expression of interest. It does not create a membership, partnership, agency, employment or contractual relationship, and does not obligate you or us to anything. Any participation will require separate written agreements. Nothing on the Site is an offer, guarantee or promise of any payment, revenue share or other compensation. Statements about future value-sharing are goals only and are subject to change.
4. Your information
You agree that the information you submit is accurate and that you have the right to submit it. Do not submit information about other people without their permission. Our handling of personal information is described in our Privacy Policy.
5. Communications
By submitting a form, you agree that we may contact you by email, and, if you provide a phone number and give consent, by phone call or text message, about Open Real Estate, including updates, informational sessions and next steps. Where you consent to calls or texts, you agree that they may be made using automated technology. Consent to calls and texts is not required to use the Site. You can opt out at any time by clicking "unsubscribe" in any email or replying STOP to any text. Message frequency varies, and message and data rates may apply.
6. Acceptable use
Do not misuse the Site, including by: submitting false, misleading or unlawful information; impersonating another person or organization; attempting to gain unauthorized access, scraping, or interfering with the Site; introducing malware; or using the Site in violation of any law.
7. Intellectual property
The Site, its content, name and logos are owned by us or our licensors and protected by law. You may view the Site for your own informational use. You may not copy, modify or redistribute Site content for commercial purposes without our written permission. Third-party names and marks belong to their owners; their mention does not imply endorsement beyond what the Site expressly states.
8. No professional advice
The Site is provided for general information only. It is not legal, financial, tax or business advice.
9. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Open Real Estate and its affiliates, members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed $100. Some jurisdictions do not allow certain limitations, so some of this may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from claims and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms or applicable law.
12. Changes and termination
We may modify the Site or these Terms at any time. Changes take effect when posted, with the effective date updated. Continued use means you accept the changes. We may suspend or end access to the Site at any time.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to that jurisdiction.
